Introduction

Welcome to PitchNest

These Terms of Service govern your use of the PitchNest platform and services, which provide a marketplace for product launches, review video content creation, and community engagement.

By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

Account and Registration

  • You must be at least 18 years old to use our Service
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the security of your account and password
  • You may not use the Service if you are barred from receiving services under applicable laws
  • One person or legal entity may not maintain more than one account
  • Accounts created by automated methods are not permitted

Acceptable Use

You agree to:

  • Use the Service in compliance with all applicable laws and regulations
  • Provide accurate information about your products and services
  • Respect intellectual property rights of others
  • Maintain professional conduct in all interactions

You agree NOT to:

  • Submit false, misleading, or fraudulent product information
  • Violate any laws or regulations
  • Infringe upon intellectual property rights
  • Engage in spam, harassment, or abusive behavior
  • Attempt to circumvent our security measures
  • Use automated systems to access the Service without permission

Review Video Ownership & Rights

Important

Important: PitchNest Retains Full Ownership

PitchNest retains full ownership of all video content produced through Review Video Kit services and review video call recordings.

What you receive:

  • A non-exclusive, non-transferable license to use a copy of the video without watermark
  • Rights to use the video for your own promotional purposes
  • Permission to edit/adapt the video for your own channels (e.g., trims, captions/subtitles, intro/outro, overlays)
  • Permission to publish the video on your website and your YouTube channel
  • A shareable link once the video is published on YouTube

Important restrictions:

  • License is granted solely to the product owner (non-transferable; no sublicensing)
  • No third‑party processing: you may not send the video to external agencies/vendors for editing or repurposing
  • Do not claim exclusive ownership or file takedown/Content ID claims against PitchNest's uploads
  • Do not distribute the content to stock libraries, paid syndication networks, or marketplaces
  • This license does not grant ownership rights; PitchNest remains the sole owner of the video

YouTube Publication

Review videos will be published on PitchNest's official YouTube channel

  • Videos are published to increase visibility and reach
  • You'll receive a shareable link once the video goes live
  • You may share and promote the YouTube link, and you may upload the video to your own website and YouTube channel
  • When uploading to your channel, include attribution "Review by PitchNest" and a link to the original PitchNest video
  • Please do not enable Content ID claims or submit copyright/takedown claims against PitchNest's uploads of the same video

Content Creation Process

  • All review video calls will be professionally recorded and edited by PitchNest
  • Final content editing decisions rest solely with PitchNest
  • Publication timeline is typically within 14 days of call completion
  • PitchNest may choose not to publish content that doesn't meet quality standards
  • PitchNest reserves the right to use review video content for marketing purposes across all platforms

Product Submissions and Launch Process

  • Featured Submissions: Instant approval and featured placement for 15 days from launch
  • Content Guidelines: All submissions must comply with our content guidelines
  • Rejection Rights: We reserve the right to reject submissions that violate our guidelines
  • Launch Scheduling: Scheduled launches are subject to availability and confirmation

Intellectual Property

  • You retain ownership of your product information and materials submitted to PitchNest
  • You grant PitchNest a license to display and promote your product on our platform
  • PitchNest owns all rights to the platform, branding, and review video content we create
  • You may not use PitchNest's branding or intellectual property without permission

Limitation of Liability

To the maximum extent permitted by law, PitchNest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

Termination

  • You may terminate your account at any time
  • We may terminate or suspend accounts for violations of these Terms
  • Upon termination, your access to the Service will cease immediately
  • Termination does not affect rights and obligations that arose before termination
  • Published review video content will remain available as per our ownership rights

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date.

Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
